Introduction

These terms and conditions will apply to all transactions placed online with David Oakes Prints.  They do not affect your statutory rights.  By placing an order from the  site you are agreeing to the terms and conditions.  

Personal Customers
We are pleased to accept online order transactions via our secure server.  All credit or  debit card transactions may be subject to validation checks by the card issuer.  If the issuer of your card refuses to authorize payment to us, we will not be liable for any delay and/or non-delivery of your order. We are pleased to accept orders where the buyer wishes to pay by cheque.  We will issue a pro forma invoice to allow the purchaser to send a cheque.  We will release goods once a cheque has cleared.  

Trade Orders
We are happy to accept orders from shops, galleries and commercial suppliers. There is no minimum order. Please contact David Oakes Prints (art@davidoakes.co.uk) to discuss your requirements.  

Placing an order
No binding contract will exist between us until we have accepted the order.  All goods are sold subject to availability and maybe placed on back order. If for any reason we are unable to fulfil any part of the order, we will refund your card as soon as practical and in any case within twenty one days.

Products, Prices & Content
Every effort is made to ensure images and colours shown on the site match as closely as possible to those of the actual products however, due to technical limitations, some colours may vary. All prices are show in pounds sterling.  The advertised delivery charge will be added to your order. The final price quoted on the payment page is the price on the goods including delivery to the stated destination in the UK.  

Cancellation
You may cancel a contract to purchase a product or products from us at anytime within seven working days after the day you received the order.  In order to cancel a contract in this way, you must provide written notice of cancellation. All goods must be returned to us within seven days of our acceptance of the cancellation. Items received later than this can only be accepted for return at our discretion.

Cancellation of Bespoke Orders
In accordance to the Distance Selling and Online Trading Regulations David Oakes Prints goods which have been made to the customer specifications are exempt from standard cancellation rights. Cancellations are offered subject to the discretion of David Oakes Prints.  Please contact us at art@davidoakes.co.uk if you wish to cancel an order.

Delivery
If you have selected our ‘standard delivery’ option, it is our aim to deliver to you within ten working days of receipt of payment.  In the event that we are unable to achieve this and a delay to your delivery will occur, we will endeavour to email you with an expected delivery date or the option to cancel your order.

Returns
In the event that you need to return your items David Oakes Prints will exchange or refund products provided that they are delivered in the original condition within fourteen days of receipt. Good being sent back to David Oakes Prints are your responsibility until they reach us. David Oakes Prints cannot be held responsible for anything that gets lost or damaged in transit.  Delivery charge and returned postage will only be refunded if an item is faulty.  

Ownership of Goods
All items supplied to the customer remain the property of David Oakes Prints until the final payment of all sums owing in respect to those goods has been received in full by us. 

Intellectual Property
All copyright, design rights and intellectual property rights existing in our designs and products and in the images, text and design of our website are and will remain property of David Oakes Prints. The copying, modification, distribution, reproduction or incorporation into any other work of part or all the material available on this website in any form is prohibited without written permission.

Privacy Policy & Security
We are committed to ensuring that your information is secure.  In order to prevent unauthorized access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online. We do not disclose details of our customers to any third party but we do use it to advise our clients of goods and services we feel may be interest to them, unless expressed instructed otherwise in writing.  We will collect and store any personal data that you may volunteer whilst using our services e.g. placing an order or joining our email newsletter.  The type of information that we will collect will include – your title and name, known address, known telephone numbers, email address, order details.   The information will be used to process orders, for internal record keeping and we may periodically send promotional emails about new products, special offers or other information that we think you may find interesting using the email address you have provided.

You may wish to restrict the collection or use of your personal information in the following ways: 
- Whenever you are asked to fill in a form on the website, look for the box that you can indicate that you would not like the information to be used by anybody for direct marketing purposes.
- If you have previously agreed to using your personal information for direct marketing purposed, you may change your mind at any time by writing or emailing us at art@davidoakes.co.uk. 

Responsibility
David Oakes Prints cannot be held responsible for any disruptions to our services that are beyond our reasonable control.  We will do everything in our power to correct any disruption to our service.  

Law & Territory
These Terms & Conditions and your use of our website are governed by English law and you agree to submit to the non-exclusive jurisdiction of the English court.  This does not affect your non-excludable statutory rights.

This website and our terms and conditions have been designed for use within the United Kingdom and under UK law.  Whilst we are happy to consider requests for products and inquiries from outside the United Kingdom, we give no warranty, express or implied that the use of this website or the placing of any order through this website from outside the UK complies with any applicable non-UK laws or regulations. Accordingly, any products or promotions not permitted under your local law are not offered to you.
